Terms of Service
Last Updated: October 22, 2026
Welcome to AVAHEL.
AVAHEL is a luxury-focused watches and jewellery brand dedicated to considered design, refined craftsmanship, and a distinguished client experience. These Terms of Service govern your access to and use of our website, online store, products, and related services.
Throughout these Terms, “AVAHEL,” “we,” “us,” and “our” refer to AVAHEL. “You,” “your,” and “customer” refer to any individual who visits our website, creates an account, places an order, or otherwise uses our services.
Our online store is powered by Shopify, which enables us to present our collections and provide our e-commerce services.
By accessing our website or placing an order, you agree to these Terms and the policies referenced herein, including our Privacy Policy and Returns & Refunds Policy. Please read them carefully before making a purchase.
If you do not agree to these Terms, please discontinue use of the relevant services.
1. General Conditions and Eligibility
1.1 Eligibility
By using our website, you confirm that you are legally capable of entering into a binding agreement under the laws applicable to you.
If you are below the age of majority in your jurisdiction, you may use our services only where permitted by applicable law and with the involvement or consent of a parent or legal guardian, as required.
1.2 Permitted Use
You agree to use our website and services only for lawful purposes.
You must not:
- Violate any applicable law, regulation, or third-party right.
- Use our website for fraudulent, deceptive, or unauthorised activities.
- Attempt to interfere with the operation, security, or integrity of our website.
- Introduce malicious software, harmful code, or other disruptive material.
- Attempt to gain unauthorised access to accounts, systems, or information.
- Copy, scrape, or extract website content in a manner that violates applicable law or our rights.
- Use our services to distribute spam, impersonate others, or misrepresent your identity.
We reserve the right to take reasonable and proportionate action where misuse is identified, subject to applicable law.
1.3 Account Responsibility
If you create an account, you are responsible for providing accurate information and taking reasonable steps to protect your login credentials.
Please notify us if you suspect unauthorised access to your account.
AVAHEL may restrict or suspend account access where reasonably necessary to investigate suspected fraud, protect customers, maintain website security, or comply with legal obligations. Where appropriate, we will provide relevant information about the restriction.
2. Products, Descriptions, and Availability
2.1 Product Presentation
AVAHEL endeavours to present its watches and jewellery with accurate product descriptions, photographs, specifications, and other relevant details.
We take care in representing the appearance, materials, colours, finishes, dimensions, and features of our products. However, the appearance of an item may vary slightly depending on lighting, photography, screen settings, and device displays.
Any such variation does not affect your statutory rights where a product is materially different from its description or otherwise fails to meet applicable legal requirements.
2.2 Product Information
Product specifications, materials, dimensions, features, included accessories, and other details are provided to help you make an informed purchasing decision.
Please review the individual product page carefully before placing an order. If you require clarification about a product, our Client Concierge can assist you before purchase.
Where a product includes a manufacturer warranty, brand warranty, authenticity documentation, or other supporting materials, the applicable details will be communicated through the relevant product listing or accompanying documentation.
2.3 Availability
All products are offered subject to availability.
We may update, modify, replace, or discontinue products and collections as our business evolves. A product appearing on our website does not guarantee that it will remain available when you place an order.
If an item becomes unavailable after an order has been submitted, we will contact you regarding the available options, which may include cancellation and a refund for any amount paid for the unavailable item.
2.4 Product Restrictions
We reserve the right, where reasonably necessary and permitted by law, to limit quantities, restrict certain transactions, or decline orders where there is a legitimate concern regarding fraud, resale activity, inventory limitations, delivery restrictions, or misuse of our services.
Any such action will be handled consistently with applicable consumer protection requirements.
3. Prices, Taxes, and Promotions
3.1 Currency and Pricing
Unless expressly stated otherwise, prices displayed on our Pakistani store are in Pakistani Rupees (PKR).
Product prices, promotional offers, and delivery charges may change from time to time. The applicable price and charges will be displayed during checkout or otherwise communicated before you commit to your purchase.
A price change made after an order has been accepted will not, by itself, change the agreed price for that order.
3.2 Taxes and Additional Charges
Applicable taxes, delivery fees, and other charges will be disclosed at checkout or before order confirmation, where required.
If you purchase from outside Pakistan, additional duties, import taxes, customs charges, or other local fees may apply depending on the destination and the arrangements for your shipment. Responsibility for these charges will be communicated where relevant and determined by the applicable shipping terms and law.
3.3 Promotional Offers
Promotional codes, discounts, gifts, and special offers may be subject to specific eligibility conditions, validity periods, exclusions, or minimum purchase requirements.
Unless expressly stated otherwise or required by law:
- Promotional codes must be used in accordance with their stated conditions.
- Offers cannot be redeemed after their expiry date.
- Multiple offers cannot necessarily be combined.
- Promotional benefits are not redeemable for cash unless expressly stated.
- Offers may be withdrawn or amended prospectively, subject to applicable law and existing accepted orders.
If a promotion is applied incorrectly because of a technical error, we will review the circumstances and communicate an appropriate resolution.
4. Orders and Order Acceptance
4.1 Placing an Order
When you submit an order, you are making a request to purchase the selected products under the terms displayed at checkout.
You must provide accurate contact, billing, delivery, and payment information so that we can process and fulfil your order.
4.2 Order Confirmation
An automated order acknowledgement or confirmation email confirms that we have received your order. It does not necessarily constitute final acceptance of the order.
Order acceptance may be communicated through a subsequent confirmation, dispatch notification, or other appropriate communication, depending on our order-processing procedures.
4.3 Order Review and Cancellation
We may review an order before acceptance to verify payment, confirm availability, check delivery information, or investigate suspected fraud.
Where reasonably necessary and permitted by law, we may decline or cancel an order for reasons including:
- The product is unavailable or has been incorrectly listed.
- A material pricing or technical error has occurred.
- Payment cannot be verified or authorised.
- The delivery information is materially incomplete or invalid.
- The order appears fraudulent, unauthorised, or inconsistent with our legitimate sales restrictions.
- We are unable to fulfil the order for a lawful operational reason.
If we cancel an order after payment has been received, we will arrange an appropriate refund for the amount paid for the cancelled order or affected items, subject to applicable law.
We will communicate relevant cancellation information to the customer. Nothing in this section permits AVAHEL to disregard a binding order or a consumer right that has already arisen under applicable law.
4.4 Changes to Submitted Orders
If you need to change or cancel an order, contact our Client Concierge as soon as possible.
We will make reasonable efforts to assist where the order has not yet entered fulfilment or dispatch. Changes cannot be guaranteed once processing or shipment has begun.
Your statutory cancellation and return rights, where applicable, remain unaffected.
5. Payments, Billing, and Cash on Delivery
5.1 Accepted Payment Methods
Available payment methods may include:
- Cash on Delivery (COD).
- Debit and credit cards.
- Direct bank transfers.
- JazzCash and Easypaisa.
- Other payment methods expressly displayed at checkout.
Available methods may vary depending on the order, delivery destination, payment provider, or technical availability.
5.2 Payment Authorisation
By selecting a payment method, you confirm that you are authorised to use it and that the information provided is accurate.
Electronic payments may be subject to authentication, fraud screening, payment-provider approval, and other verification procedures.
AVAHEL does not guarantee that every payment transaction will be authorised by the relevant provider.
5.3 Cash on Delivery
Where COD is available, you agree to pay the applicable order amount and disclosed charges in accordance with the delivery and collection arrangements communicated to you.
We may contact you to verify a COD order before dispatch. Where an order cannot reasonably be verified or there is a legitimate concern regarding fraud or repeated misuse, we may delay, restrict, or cancel it in accordance with applicable law.
5.4 Bank Transfers and Mobile Wallets
For bank transfers or mobile wallet payments, your order may require payment verification before dispatch.
Please follow the payment instructions supplied through our authorised channels. Do not share your PIN, password, OTP, or other authentication credentials with anyone claiming to represent AVAHEL.
5.5 Billing Information
You agree to provide complete, accurate, and current billing and contact information and to update it where necessary.
We may contact you if additional information is reasonably required to process, verify, or fulfil your order.
6. Shipping, Delivery, and Risk
6.1 Delivery Destinations
AVAHEL offers delivery to the locations available at checkout or otherwise confirmed by our team.
Delivery availability may depend on courier coverage, product availability, security restrictions, and other operational considerations.
6.2 Delivery Estimates
Estimated delivery times are provided for guidance and are not guaranteed unless expressly stated as a binding commitment.
Delays may arise from courier operations, weather conditions, public holidays, remote delivery locations, security restrictions, inaccurate delivery details, or other circumstances outside our reasonable control.
We will make reasonable efforts to assist you with relevant delivery enquiries.
6.3 Customer Delivery Information
You are responsible for providing an accurate delivery address and a reachable telephone number.
If delivery cannot be completed because the information supplied is incorrect or because the recipient is unavailable, the courier may attempt redelivery, return the parcel, or apply other procedures under its service terms.
Any additional charges or arrangements arising from an unsuccessful delivery will be handled transparently and in accordance with applicable law.
6.4 Inspection Upon Delivery
We encourage you to inspect your package upon receipt and contact us promptly if it appears damaged, incomplete, or incorrect.
For claims involving a damaged, defective, or incorrect item, please follow the procedure in our Returns & Refunds Policy.
Photographs, packaging records, or an unboxing video may assist our investigation, but the absence of an unboxing video will not automatically eliminate any rights available to you under applicable law.
6.5 Delivery, Ownership, and Risk
Ownership and responsibility for risk of loss will transfer in accordance with the applicable sale and delivery arrangements and governing law.
Nothing in these Terms is intended to transfer risk to a consumer prematurely or to limit any protection that applicable law provides concerning delivery, ownership, or defective goods.
7. Returns, Exchanges, Refunds, and Warranties
7.1 Returns and Refunds
Returns, exchanges, and refunds are governed by our separate Returns & Refunds Policy, which forms part of these Terms.
Please review that policy before purchasing, particularly its provisions concerning the return window, product condition, original packaging, inspection, and refund methods.
You can access the policy through the relevant page on our website.
7.2 Damaged, Defective, or Incorrect Products
If a product arrives damaged, defective, or different from what you ordered, contact our Client Concierge promptly.
We will review the issue and determine an appropriate resolution in accordance with our published policy and applicable law.
Nothing in these Terms excludes or restricts remedies that are legally available for products that do not conform to the contract.
7.3 Product Warranties
Any warranty applicable to a watch or jewellery item will be determined by the warranty expressly offered for that product and the accompanying terms.
Where a manufacturer or third-party warranty applies, its scope, duration, exclusions, and claims procedure may differ from those of other products.
Please review the relevant warranty documentation and retain it with your purchase records.
Unless expressly stated, AVAHEL does not represent that every product includes a manufacturer's warranty or a particular duration of warranty coverage.
Nothing in this section excludes any mandatory consumer guarantee or statutory warranty applicable to your purchase.
8. Intellectual Property and Brand Protection
All content made available through the AVAHEL website, unless otherwise identified, is owned by or licensed to AVAHEL and may be protected by copyright, trademark, design, and other intellectual property laws.
This includes, but is not limited to:
- The AVAHEL name, wordmark, logo, and brand identifiers.
- Product photography, campaign imagery, and editorial content.
- Product descriptions, written copy, and graphics.
- Website layouts, visual elements, and original design assets.
- Videos, illustrations, and other creative materials.
- Original website code and other proprietary content.
No ownership rights are transferred to you by your access to or use of the website.
You may browse the website and use its content for personal, non-commercial shopping purposes. You must not reproduce, republish, distribute, modify, sell, commercially exploit, or create derivative works from protected content without the relevant permission, except where such use is permitted by applicable law.
Nothing in these Terms grants you permission to use AVAHEL's name, branding, or intellectual property in a way that suggests an unauthorised affiliation, endorsement, or partnership.
If you believe that content on our website infringes your intellectual property rights, please contact us with relevant supporting information so that we can review your claim.
9. Customer Reviews, Feedback, and Submissions
We welcome genuine customer feedback, product reviews, and suggestions that help us improve our collections and service.
When submitting a review, photograph, comment, suggestion, or other material, you confirm that:
- You have the right to submit that material.
- The material is accurate to the best of your knowledge.
- It does not unlawfully infringe another person's rights.
- It does not contain unlawful, misleading, abusive, or malicious content.
- You have obtained any necessary permissions for identifiable individuals shown in submitted material.
You retain ownership of content you create, subject to any rights you separately grant.
By submitting content for publication or use by AVAHEL, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, and distribute that content for the purposes reasonably connected with displaying the submission, operating our services, or promoting the relevant review or product, subject to applicable law.
Where a proposed use goes beyond these purposes, such as featuring a customer's photograph in a separate advertising campaign, we will obtain any additional permission required by law.
We may moderate, decline, or remove submissions that violate these Terms, applicable law, or our reasonable content standards.
We are not obliged to publish every review or suggestion. We will not represent a fabricated or materially misleading review as a genuine customer experience.
10. Third-Party Services and External Links
Our website may use or link to services provided by third parties, including Shopify, payment processors, courier companies, social media platforms, analytics providers, and messaging services.
These services may be subject to separate terms, privacy policies, and operating procedures.
AVAHEL does not control every aspect of independent third-party services and is not responsible for their independent policies or practices, except to the extent responsibility cannot lawfully be excluded.
Your use of a third-party service may be subject to the terms you agree to with that provider.
Where a third-party service is necessary to complete your purchase, we will provide the relevant information or access required to use that service.
11. Privacy and Personal Information
Your use of the AVAHEL website is also governed by our Privacy Policy, which explains how we collect, use, disclose, and retain personal information.
We may process information to fulfil orders, communicate with customers, administer accounts, prevent fraud, improve our website, and meet legal obligations, as described in that policy.
Please review our Privacy Policy to understand your available privacy choices and how to contact us with a personal-information request.
Where consent is required by law for a particular processing activity, these Terms do not replace that consent.
12. Website Availability and Technical Errors
We aim to maintain a reliable and accessible website. However, uninterrupted availability cannot be guaranteed.
Our website may occasionally be unavailable or experience errors because of maintenance, technical issues, security incidents, network interruptions, or service-provider disruptions.
We may update, maintain, or modify website features from time to time.
We will take reasonable steps to address material errors affecting orders or customers. If a technical issue materially affects your purchase, please contact our team so that we can investigate and determine an appropriate resolution.
13. Disclaimer of Warranties
To the extent permitted by applicable law, the AVAHEL website and its general informational content are provided on an “as available” basis.
We make reasonable efforts to ensure that website information is accurate, current, and useful. However, we do not guarantee that every page, feature, or item of information will always be uninterrupted, error-free, or available.
Product-specific descriptions, contractual commitments, and applicable consumer rights remain subject to their relevant terms and governing law.
Nothing in these Terms excludes, restricts, or modifies a warranty, guarantee, remedy, or consumer protection right that cannot lawfully be excluded, restricted, or modified.
14. Limitation of Liability
To the extent permitted by applicable law, AVAHEL will not be liable for losses that are not reasonably foreseeable or that arise from circumstances outside the scope of our legal responsibility.
Subject to applicable law, we are not responsible for loss arising solely from:
- Your misuse of the website or failure to follow reasonable security precautions.
- Inaccurate information supplied by you.
- Independent third-party services outside our reasonable control.
- Interruptions caused by circumstances beyond our reasonable control.
Nothing in this section excludes or limits liability for fraud, wilful misconduct, death or personal injury where liability cannot lawfully be excluded, breach of a mandatory legal obligation, or any other liability that applicable law does not permit us to limit.
Where a product or service fails to meet an applicable legal requirement, this section does not remove any remedy to which you are legally entitled.
15. Indemnification
To the extent permitted by applicable law, you agree to be responsible for reasonable losses, liabilities, and expenses arising directly from your unlawful use of our services, your infringement of third-party rights, or your material breach of these Terms.
This provision does not apply to the extent a claim results from AVAHEL's own unlawful conduct, negligence where liability cannot lawfully be excluded, or other circumstances for which you cannot legally be held responsible.
Any claim for indemnification must be proportionate to the circumstances and subject to applicable law.
16. Suspension and Termination
We may suspend or restrict access to some or all of our services where reasonably necessary to protect the security of our website, investigate suspected fraud, address serious misuse, or comply with legal requirements.
Where appropriate and legally permitted, we will notify you of the relevant action and any steps available to resolve the matter.
You may stop using our website at any time. If you have an outstanding order, any obligations or rights relating to that order will continue in accordance with the applicable agreement and law.
Termination or suspension does not affect rights, liabilities, or obligations that accrued before the relevant date.
17. Events Beyond Our Reasonable Control
AVAHEL will not be responsible for a delay or failure to perform an obligation to the extent it is caused by an event beyond our reasonable control.
Such events may include natural disasters, severe weather, public emergencies, government restrictions, widespread transport disruptions, major utility failures, or interruptions to essential third-party services.
We will make reasonable efforts to reduce the impact of such events and resume performance when practicable.
This provision does not remove any refund, cancellation, delivery, or other consumer rights that remain applicable in the circumstances.
18. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Islamic Republic of Pakistan, subject to any mandatory consumer protection or other legal requirements that apply to your transaction.
If you have a concern about an order or our services, we encourage you to contact our Client Concierge first so that we can attempt to resolve the matter promptly and fairly.
If a dispute cannot be resolved informally, it may be referred to the competent court or other legally authorised forum with jurisdiction over the matter.
Nothing in these Terms deprives a consumer of a mandatory legal right to bring a claim before a competent authority or forum.
19. Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be interpreted or limited to the extent necessary to make it enforceable where legally permissible.
If it cannot be made enforceable, it will be severed to the extent required, and the remaining provisions will continue in effect.
The invalidity of one provision will not automatically invalidate the remaining Terms.
20. No Waiver
If AVAHEL does not exercise or enforce a right under these Terms on a particular occasion, this does not automatically constitute a waiver of that right.
Any waiver will apply only to the extent expressly stated or required by applicable law.
21. Entire Agreement and Interpretation
These Terms, together with the policies and additional terms expressly incorporated into them, govern your use of the AVAHEL website and the relevant services.
Product-specific terms, accepted order details, warranty documentation, and other expressly agreed contractual terms may supplement these Terms where applicable.
If there is a conflict between these Terms and a mandatory legal requirement, the mandatory legal requirement will prevail.
If there is a conflict between these Terms and our Returns & Refunds Policy regarding the practical administration of returns or refunds, the specific policy will apply to that subject to the extent consistent with applicable law.
22. Changes to These Terms
AVAHEL may revise these Terms to reflect changes to our business, website functionality, products, services, or legal obligations.
The updated version will be published on this page with a revised “Last Updated” date.
Changes will apply prospectively unless otherwise permitted by applicable law. Where a change materially affects an existing order or contractual right, we will respect the terms and legal protections applicable to that transaction.
Your continued use of our website after updated Terms become effective will be treated in accordance with applicable law and any consent or notice requirements.
We encourage you to review this page periodically.
